Welcome to EVETS Software Solutions. By using our website (https://evets.net), client portal, cloud software products, mobile applications, APIs, or enterprise services, you acknowledge that you have read, understood, and agree to be bound by the following Terms and Conditions.
1. Definitions & Scope
- "EVETS", "Company", "We", "Us", or "Our" refers to EVETS Software Solutions, registered in Sri Lanka, operating internationally across South Asia, the Middle East, Europe, and globally.
- "Client", "Customer", "User", or "You" refers to the individual, enterprise, or legal entity purchasing, subscribing to, or accessing EVETS software products, cloud services, or bespoke solutions.
- "Services" refers to cloud-hosted software (SaaS), Enterprise Resource Planning (ERP), Point of Sale (POS), Customer Relationship Management (CRM), Field Service management, mobile applications, dedicated hosting, custom software development, and technical support provided by EVETS.
2. Provision of Cloud Software & SaaS Subscriptions
EVETS grants the Client a non-exclusive, non-transferable, revocable license to access and utilize our software services in accordance with the subscribed plan or purchase agreement.
- Subscription Terms: SaaS plans (e.g. Field Service SaaS, Business OS, POS Cloud) are billed on a recurring monthly or annual basis as specified in the checkout or quotation.
- Server Infrastructure: Cloud software is hosted on secure NVMe VPS infrastructure with automated daily backups, SSL encryption, and high availability.
- Upgrades & Maintenance: EVETS continuously provides security patches, software updates, and performance optimizations. Scheduled maintenance will be notified in advance via the Client Portal or email.
3. Invoicing, Payments & Currency
All financial transactions conducted via EVETS follow rigorous security and regulatory standards:
- Supported Payment Methods: We accept Credit/Debit Cards (Visa, MasterCard, American Express) via the PAYable IPG Commercial Bank of Ceylon Gateway, international payments via PayPal, direct Bank Wire Transfers, and local banking clearing.
- Currencies: Payments are processed in the currency specified on the official invoice or checkout screen (primarily USD, LKR, EUR, or GBP).
- Payment Due Dates: Invoices issued for recurring services or milestone deliverables must be settled by the specified due date. Late payments may result in temporary service suspension until cleared.
- Electronic Receipts: An official electronic receipt and payment confirmation will be automatically generated and delivered upon successful settlement.
4. Custom Software Development & Milestone Agreements
For custom engineering and bespoke ERP/web application projects:
- Scope of Work: Development work is executed based on the mutually agreed Project Scope, Quotation, and Service Agreement.
- Milestone Approvals: Clients are required to review and electronically approve completed milestones via the EVETS Client Portal or in writing.
- Change Requests: Any features or requirements requested outside the signed scope will be documented and billed separately as an agreed addendum.
5. Client Portal & Account Security
Clients are responsible for maintaining the confidentiality of their login credentials (passwords, 2FA/OTP codes, API keys) for the EVETS Client Portal. Any activity originating from your verified account is presumed authorized by your enterprise.
6. Intellectual Property Rights
- EVETS Proprietary IP: EVETS retains all intellectual property rights, trademarks, core framework codebase, and proprietary architecture powering our SaaS platforms.
- Client Data: All operational data, customer lists, transactional records, and business assets uploaded by the Client remain the exclusive property of the Client.
7. Third-Party Integrations (WhatsApp Business API & Gateways)
When using integrated third-party platforms (including Meta WhatsApp Business Cloud API, Commercial Bank Gateway, Google Workspace, SMTP relay), the Client agrees to comply with the respective third-party acceptable use policies and terms.
8. Limitation of Liability & Warranty
While EVETS takes every technical measure to ensure uninterrupted uptime, high security, and software precision:
- EVETS services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
- To the maximum extent permitted by applicable law, EVETS shall not be liable for indirect, incidental, punitive, or consequential damages resulting from unforeseen downtime, network latency, or unauthorized third-party intrusion.
9. Termination of Service
Either party may terminate a subscription service by providing written notice prior to the upcoming billing cycle. Upon termination, the Client may request a complete export of their operational data within 30 calendar days.
10. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of Sri Lanka. Any legal proceedings arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in Sri Lanka, unless an international arbitration clause applies.
